SOLLERTIA – INGENIA TÉCNICA, S.A. (hereinafter, “SOLLERTIA”), a company duly incorporated in the Republic of Panama under tax ID 155754354-2-2024, with commercial domicile at Vía Ricardo J. Alfaro, PH The Century Tower, Office 905-1, Betania, Panama City, in its capacity as data controller, informs you (hereinafter, “the Data Subject”) of the conditions under which the personal data collected through the website www.sollertia-intec.com, the Client Portal and the official communication channels is processed, in compliance with Law 81 of March 26, 2019, on Protection of Personal Data of the Republic of Panama, its regulations and other applicable rules.

1. Personal data collected

To process a service request (REQ), SOLLERTIA collects the following information:

  • Identification data: full name, role or position.
  • Contact data: email address, phone number, WhatsApp number.
  • Commercial data: legal company name, tax identification number, industry or sector.
  • Site or facility data: address, city or province, technical characteristics declared by the Data Subject (amperage, number of panels, type of installation).
  • Consent data: evidence of acceptance of the Terms and Conditions and of this Policy, including date, time, IP address, and browser user agent.
  • Web traffic data: cookies and browsing data, in accordance with the website cookie policy.

SOLLERTIA does not intentionally collect special categories of personal data (sensitive data).

2. Purposes of processing

Personal data is processed exclusively for the following purposes:

  1. Validate the service request, the described scope and technical feasibility.
  2. Prepare and send preliminary and formal commercial proposals.
  3. Coordinate technical visits, inspections and contracted works.
  4. Issue electronic invoicing in accordance with the regulations of the Directorate General of Revenue of Panama (DGI).
  5. Maintain communication during service delivery and after-sales.
  6. Send commercial communications only when the Data Subject has given explicit consent (“marketing opt-in”).
  7. Comply with applicable legal, fiscal, regulatory or judicial obligations.
  8. Retain technical records as professional evidence and for warranty claims.

3. Legal basis

Processing is based on:

  • Express and informed consent of the Data Subject, given by checking the corresponding boxes when submitting the Client Portal form.
  • Execution of a contractual or pre-contractual relationship with the Data Subject.
  • Legitimate interest of SOLLERTIA to offer and provide its professional electrical engineering services.
  • Compliance with legal obligations in tax and technical matters.

4. Recipients and transfers

The Data Subject’s data may be shared with the following recipients, under strict confidentiality and only for the stated purposes:

  • THE FACTORY HKA CORP (tax ID 155596713-2-2015), Qualified Authorization Provider (PAC) authorized by the DGI, for the issuance of electronic invoices and associated tax documents.
  • Regulatory, judicial, tax or administrative authorities of the Republic of Panama, under legal request.
  • Technology service providers contracted by SOLLERTIA (email, storage, hosting), always under equivalent confidentiality and data protection clauses.

When a service involves international transfer of data (e.g., cloud storage outside Panama), SOLLERTIA selects providers that guarantee equivalent levels of protection.

5. Retention period

Personal data is retained:

  • For the entire duration of the contractual relationship.
  • For an additional period of ten (10) years for electrical inspection records, technical proposals and reports, in line with the recommended technical standard and for purposes of legal evidence and claims.
  • For the periods required by Panamanian tax legislation, when applicable.

Upon expiration of these periods, data is securely deleted or anonymized.

6. Data Subject rights

Under Law 81, the Data Subject has the right to:

  • Access: know what personal data is held by SOLLERTIA.
  • Rectification: correct inaccurate, incomplete or outdated data.
  • Cancellation or erasure: request deletion when data is no longer necessary.
  • Objection: object to processing on legitimate grounds.
  • Portability: receive data in a structured and commonly used format.
  • Restriction of processing.
  • Withdraw consent previously granted, without affecting the lawfulness of prior processing.

To exercise these rights, the Data Subject may write to ingenieria@sollertia-intec.com, providing adequate identification. SOLLERTIA will respond within a period of no more than thirty (30) calendar days.

7. Security measures

SOLLERTIA applies technical, organizational and administrative measures to protect the Data Subject’s data against unauthorized access, loss, alteration or improper disclosure. Among them:

  • Role-based access control with user authentication.
  • Encryption of communications (HTTPS) on the website.
  • Immutable audit log of processing events.
  • Storage with providers offering security guarantees.
  • Staff training on data protection.

8. Cookies

The website uses essential technical cookies for operation, analytical cookies to measure traffic and, optionally, marketing cookies upon prior authorization of the Data Subject via the cookie banner.

9. Minors

The Client Portal and SOLLERTIA’s services are intended exclusively for adults and for legal entities represented by adults. SOLLERTIA does not intentionally process personal data of minors.

10. Changes to this Policy

SOLLERTIA may update this Policy. The version in force at the time of submission of each request (REQ) will be the one applicable to such processing. Substantive changes will be notified via the website and, where applicable, by email to the Data Subject.

11. Competent authority

The competent authority on personal data protection in the Republic of Panama is the National Authority for Transparency and Access to Information (ANTAI). The Data Subject may file complaints before this authority if they consider that their rights have not been respected.
